Gas Safety for Airbnb and Short-Term Let Hosts in London: Legal Obligations Explained

London short-term let hosts who use gas appliances in their properties have specific gas safety obligations that go beyond those of standard residential landlords. The combination of frequent guest changeover, property absence periods, and the commercial nature of the activity creates a distinct legal and practical framework that hosts must understand.

How Short-Term Letting Affects Gas Safety Obligations

The Gas Safety (Installation and Use) Regulations 1998 impose specific obligations on landlords who let properties containing gas appliances. A short-term let host in London who provides accommodation in a property with a gas boiler, gas cooker, or gas fire is acting as a landlord within the meaning of the Regulations, regardless of whether the arrangement is formalised through a tenancy agreement or through a platform such as Airbnb. The obligation to ensure gas appliances are safe and the obligation to carry out an annual gas safety check apply to the arrangement just as they apply to a conventional assured shorthold tenancy.

The Health and Safety Executive has confirmed that the gas safety obligations under the 1998 Regulations apply to any residential let of less than twelve months where a landlord provides accommodation and retains responsibility for maintenance of gas appliances. A short-term let, whether for a weekend or a month, falls squarely within this definition. A London Airbnb host who has not had gas appliances inspected by a Gas Safe registered engineer and who cannot produce a current Gas Safety Record is in breach of the Regulations and faces potential criminal prosecution as well as civil liability in the event of any gas-related incident involving guests.

What a Gas Safety Check Must Cover for Short-Term Lets

A Gas Safety Record for a London short-term let property must cover all gas appliances in the property, including the boiler, any gas fire, a gas cooker or hob, and any gas pipe connections serving these appliances. The inspection is carried out by a Gas Safe registered engineer who checks each appliance for safe operation, adequate ventilation, correct flue performance, absence of gas leaks, and compliance with the relevant appliance safety standards. The engineer completes the Gas Safety Record documenting the inspection findings and the outcome for each appliance. Appliances that are found to be immediately dangerous must be taken out of service before the engineer leaves the property.

The Gas Safety Record must be renewed annually. For a short-term let property in London that is in continuous use throughout the year, the annual renewal date may fall during a period when guests are in the property. The gas engineer can carry out the inspection while the property is occupied, but the host must ensure that guests are informed and that access is available. Unlike a conventional tenancy where a twenty-four hour minimum notice requirement applies for gas safety inspections, short-term let arrangements may have more limited notice provisions, making it important to build the annual inspection into the property management calendar rather than leaving it to arise unexpectedly.

Carbon Monoxide Alarm Requirements for London Short-Term Lets

The Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022 require landlords in England to install a carbon monoxide alarm in any room containing a gas appliance. For a London short-term let property, this means a carbon monoxide alarm must be present in the kitchen where a gas cooker or hob is installed, in the living room where a gas fire is installed, and in any room containing the gas boiler. The alarms must be in working order at the start of each new occupancy period. A short-term let host who provides accommodation without carbon monoxide alarms in rooms containing gas appliances is in breach of the 2022 Regulations and may face a civil penalty notice from the local authority of up to five thousand pounds. Prestige Engineers carry out annual gas safety inspections for London Airbnb and short-term let hosts, provide current Gas Safety Records, and install and test carbon monoxide alarms as part of a complete gas safety compliance service.
