Is a legionella risk assessment a legal requirement for landlords?

Yes. The Control of Substances Hazardous to Health Regulations 2002 (COSHH) and the Health and Safety at Work Act 1974 require landlords to assess and control legionella risks in their properties. The HSE's L8 Approved Code of Practice sets out the duty.

How often does a legionella risk assessment need to be done?

There is no fixed statutory interval but the assessment should be reviewed whenever there is a change in the water system (new boiler, new pipework, new tenants) or after a period of property vacancy. For simple domestic systems, reviewing every 2 years is typical best practice.

Do I need a legionella risk assessment for a flat with a combi boiler?

Yes, but the risk is very low in properties with a combi boiler and no cold water storage tank. The assessment for such a property is simple and can often be completed by the landlord using HSE guidance, or by an engineer during a routine visit.

What increases the legionella risk in a rental property?

Higher risk factors include: cold water storage tanks (particularly old ones with sediment); hot water cylinders set below 60°C; long sections of rarely used pipework (dead legs); properties that are left empty for extended periods; and shower heads or spray fittings that are not cleaned regularly.
