What Is an HMO and Why Does Compliance Matter?

A House in Multiple Occupation (HMO) is any property rented by three or more tenants who form more than one household and share facilities such as a bathroom or kitchen. In London, HMOs are subject to significantly stricter regulatory requirements than standard buy-to-let properties. Failing to comply can result in unlimited fines, rent repayment orders, and criminal prosecution.

HMO Licensing

Mandatory HMO licensing applies to properties occupied by five or more people forming two or more households. London boroughs also operate additional and selective licensing schemes that capture smaller HMOs. Check your specific borough's requirements annually — Southwark, Newham, Hackney, and Brent all operate expanded schemes. Your licence application must include a current gas safety certificate, electrical installation condition report, and fire risk assessment.

Gas Safety

Gas Safety (Installation and Use) Regulations 1998 require an annual gas safety check by a Gas Safe registered engineer. The certificate must be provided to existing tenants within 28 days of the check and to new tenants before they move in. Keep records for a minimum of two years. For HMOs with communal boilers or shared gas appliances, this obligation is particularly important as a single failure affects all occupants simultaneously.

Electrical Safety

The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 require an Electrical Installation Condition Report (EICR) every five years. For HMOs, given the higher usage intensity, many insurers and responsible landlords commission reports every three to four years. The report must be carried out by a qualified electrician and any Category 1 or 2 defects remediated within 28 days. Portable appliance testing (PAT) is recommended for any appliances supplied with the tenancy.

Fire Safety

Fire safety for HMOs is governed by the Housing Act 2004, the Regulatory Reform (Fire Safety) Order 2005, and local authority licensing conditions. Minimum requirements typically include:

  • Interlinked mains-wired smoke alarms on every floor
  • Heat detector in the kitchen
  • Fire doors (FD30S rated) to all habitable rooms opening onto the escape route
  • Emergency lighting in communal areas for larger HMOs
  • A written fire risk assessment reviewed annually
  • Clearly displayed fire escape routes

Larger HMOs (three storeys or more) face additional requirements. Always consult your local housing authority for property-specific guidance.

Water Hygiene and Legionella

The Health and Safety Executive's ACoP L8 requires landlords to carry out a Legionella risk assessment. For most domestic HMOs, this is a straightforward documented assessment rather than ongoing monitoring, but it must be reviewed whenever significant changes are made to the water system or after a period of low occupancy. Hot water should be stored at 60°C and delivered at no less than 50°C within one minute. Cold water should be stored and distributed below 20°C. Showerheads and hoses should be descaled and disinfected regularly.

Amenity Standards

London councils set minimum room sizes, kitchen and bathroom ratios, and heating standards for HMOs. As of 2025, minimum bedroom sizes are 6.51 m² for a single occupant and 10.22 m² for two. Bathrooms and kitchens must meet specified ratios based on occupant numbers. Adequate fixed heating capable of maintaining 21°C in living rooms and 18°C in bedrooms is required.
